Ticketola (the "Website", “We”, “Us”) is a trading name of Not Just Another Dot Com Company Ltd (Company Number 4482887) and provides a fan to fan ticket exchange through the ticketola.com and ticketola.co.uk websites.
These terms and conditions of membership set out the terms under which the Website is made available to you. By registering with the Website, you become a member (a "Member") of the Website.
We reserve the right to amend the terms and conditions of this agreement, change the Website (including discontinuing any content or feature) or change any service fees for using the Website in the future.
By using the Website, you agree to be bound by all of the terms and conditions of this agreement.
Use Of The Service
To be eligible to use Ticketola you must be at least 18 years of age and you must provide certain current and accurate information about yourself at registration. This information includes your full name, email address, home address and primary telephone number.Password And Security
Access to and use of the Website is through a combination of both an email address and password. You are responsible for ensuring that you maintain the confidentiality of your password and you must not permit any third party to use the Website on your behalf. You agree to immediately notify Us of any unauthorised use of the Website through your account or any other breach of security known to you.Changes To The Site
We reserve the right, without liability, to change or discontinue any part of the Website, either temporarily or permanently. We will give you the maximum amount of notice of such modification or discontinuance as is practicable in the circumstances. We may change these terms and conditions from time to time. We will post the amended terms and conditions on the Website upon any such change. The amendments automatically become effective immediately after they are initially posted on the Website and any use of the Website occurring after such date is subject to the amendments. These terms and conditions do not transfer any right, title or interest in the content to you and you may not copy, reproduce, distribute or create derivative works from this content without expressly being authorised to do so by the Website.
You hereby irrevocably grant to Ticketola all such rights in any content that you place on the Website as shall be necessary for Us to provide a ticket exchange for our Members.
Disclaimer
We do not guarantee that Ticketola will be uninterrupted, timely, secure or error free and we make no warranty regarding the results that may be obtained from your use of the Website.Limitations Of Liability And Indemnification
We do not accept responsibility for the content of any information which Members supply through the Website and will not be liable for the content of any communication received by you from any other Member. In regard to each transaction you make at the Website, We act as an intermediary between the buyers and the sellers and you agree to accept all liability associated with the payment, delivery cost or misuse of any services or goods provided as a result of your use of the Website. We are not involved in the transactions that take place between buyers and sellers at the Website – we provide the platform (the Website) and some related services, but any contract for the sale or purchase of tickets via the Website is made between Members. You release us from claims, demands and/or damages (actual and consequential) of every kind arising out of, or in any way connected with any dispute arising from your purchase or sale of tickets at the Website. We will, however, endeavour to resolve any disputes between Members to the best of our ability. Ticketola’s liability to you shall be limited in aggregate to the total amount paid by you in relation to any transaction, including any fees paid to the Website in respect of that transaction.
Ticketola shall not be liable for personal injury or death suffered by any Member or his or her guests arising out of their attendance at, or travel to any event. Neither shall we be liable for any loss or damage sustained to any Member’s property or belongings or those of any person who uses tickets purchased by a Member at the Website.
As a Member, you agree to indemnify the Website in regard to all liabilities, claims and expenses that may arise from any breach of these terms and conditions by you.
Selling Tickets
For the purposes of these terms and conditions, the word ‘ticket’ should also be construed as ‘tickets’ if you wish to sell two or more tickets together.
You must be the lawful owner of a genuine (not fake) ticket in order to list that ticket at the Website.
To sell a ticket, you must list the ticket in the Website database. You will assign a price to the ticket and provide information in accordance with the instructions at the Website. You also grant Ticketola a non-exclusive right and license to reproduce, modify, adapt, publish and display on the Website your description of the ticket listed for sale. This is so we can promote the sale of the ticket to other Members. You are responsible for determining whether you are required to account for VAT on the sale of the ticket. We take no responsibility for such issues. If you are required to account for VAT (UK or other) on the sale of the ticket, you should include the VAT when deciding ticket prices on the Website. This is separate from any VAT Ticketola is required to charge on it's fees.
You must immediately delete a listing if the listed ticket has been sold elsewhere or if you no longer wish to sell the ticket. If another Member purchases the listed ticket at the stated price and you do not proceed with the sale, you will be liable for a sum which equates to 8% of the purchase price. This is to cover the transaction fees incurred by the Website when the ticket was purchased, and the costs of transacting a refund to the buyer.
Once a buyer has agreed to purchase your ticket at the listed price, you, as the seller, will be informed via email. You must agree to accept the sale within 24 hours by logging into your Ticketola account and following the instructions contained therein. Details of the ticket will be permanently removed from the Website listings, you will not re-list it at the Website and you will also remove any other listings for the ticket from other ticket exchanges. For the avoidance of doubt, as the seller in the transaction, you have entered into a binding contract with the Member who is the buyer and you will make no further attempt to sell the ticket, either at the Website or via any other medium or platform.
You agree to ship the ticket as soon as it is in your possession. You must allow enough time for the buyer to receive the ticket on time for the event and you must therefore ship the ticket no later than 7 days before the event. You agree to send a paper ticket to the buyer via trackable Royal Mail delivery, ie, Recorded or Special Delivery and an e-ticket (PDF format) direct to the buyer’s email address.
You will be paid by Ticketola 5-8 days after the event if the ticket was delivered successfully to the buyer. We have the right to withhold payment if the event was cancelled (and not re-scheduled) or if We, in good faith, believe that the ticket was not genuine or otherwise sold in violation of this agreement.
The payment made by Ticketola to you will be net of the service fee and the VAT on the service fee that is due to the Website. Our service fees are clearly specified in both the Help For Sellers section of the Website and in Members’ accounts when they are listing a ticket for sale.
Buying Tickets
For the purposes of these terms and conditions, the word ‘ticket’ should also be construed as ‘tickets’ if you wish to buy two or more tickets together.
If you wish to buy a ticket at the Website, you must search the Website database for a ticket that matches your criteria. Once a matching ticket at an acceptable price is located, you should follow the purchasing process as specified in the instructions at the Website.
As a buyer, you grant Ticketola permission to charge your credit card, debit card or PayPal account for the purchase of the selected ticket, as well as the specified service fee of 8% that is due to the Website. We will also add VAT to the Website’s fees as applicable. You will also be given the option of purchasing Ticketola’s ‘Fan Guarantee’. This guarantees you a full refund, including service fees, if the event is cancelled and not re-scheduled.
When you buy a ticket at the Website, certain information that you provided during registration such as your address or email address will be sent by email to the selling Member. This will enable the seller to deliver the paper ticket to you via trackable Royal Mail delivery or by email (PDF format) if the ticket is an e-ticket.
Once you have agreed to purchase a ticket and your payment has been transacted, you cannot change your mind and request a refund at a later date. You can request a refund if the event is cancelled (and not re-sheduled) if you have chosen the ‘Fan Guarantee’ option during the purchase process, if the seller has not delivered your ticket within 24-hours of the event or if the ticket you receive is not genuine or was sold in violation of this agreement. You must submit a request for a refund within three days of the date of the relevant event.
Termination Of Membership
You may terminate your membership at any time by serving written or electronic notice on the Website. We may terminate your membership at any time if you have breached these terms and conditions. Upon termination of your membership, your right to use the Website immediately ceases and you acknowledge that Ticketola may immediately delete the files in your account. Upon termination of your membership, the decision about whether you entitled to a refund of any prior sums paid to the Website or not, will be made by Ticketola’s management.Assignment
You agree that the Website has the right to assign or sub-contract any or all of its obligations under these terms and conditions.Privacy Policy
Ticketola is committed to protecting your privacy. Our aim is to ensure that you can spend your time on the Website buying tickets from, or selling tickets to other Members. Our privacy policy is intended to ensure that you can do that without having to worry about confidentiality. However, when you are are either the buyer or the seller in regard to a transaction at the Website, you agree that certain information that you provided at registration will be made available to the other party in the transaction.
1. Your name, address, email address and telephone number will not be on general display at the Website.
2. We use your personal information to facilitate the delivery of tickets from sellers to buyers and to provide our services, eg, to send you service-related messages such as transaction confirmation emails and other messages concerning your relationship with us and to help us communicate with you effectively should you contact us via the Website.
3. We will never sell, rent or otherwise share your name, email address, or other personal information with any other business or for any marketing campaign other than by Ticketola without your permission.
4. We are required to give any information you provide to legal authorities if they have the proper authorisation such as a search warrant or court order.
5. Your individual use of Ticketola and your interaction with other members of the Website will be kept strictly private.
